Prime Auto Driving School

Terms & Conditions

Last updated: August 2026

These Terms & Conditions apply to driving lessons and related services provided by Prime Auto Driving School ("Prime Auto", "we", "us" or "our").

By booking or attending a driving lesson with Prime Auto Driving School, you agree to these Terms & Conditions.

These terms are intended to be clear and fair. Nothing in these terms removes or limits any legal rights you have as a consumer.

1. Our Services

Prime Auto Driving School provides driving tuition and related driver-training services.

Our lessons are currently offered in automatic vehicles.

Driving lessons are provided by suitably qualified instructors who operate with Prime Auto Driving School.

The exact instructor, vehicle and collection arrangements may vary depending on availability and the pupil's location.

2. Booking a Lesson

Lessons may be booked through our website, by telephone, message or directly with an instructor.

A lesson is considered booked once a date and time have been agreed.

Lesson availability is subject to instructor availability.

Where a lesson has been paid for in advance, the payment will be allocated to the lessons agreed with the pupil.

3. Lesson Prices

Our current lesson prices will be displayed on our website or provided to the pupil before booking.

Prices may change from time to time.

Any price change will not affect lessons that have already been paid for and confirmed.

Where a pupil purchases a package or block of lessons, the applicable package price and conditions will be explained at the time of purchase.

4. Lesson Duration

The duration of each lesson will be confirmed at the time of booking.

The instructor will aim to provide the full agreed lesson duration.

Where a lesson is shortened because of circumstances caused by the instructor or Prime Auto Driving School, an appropriate arrangement will be made to compensate the pupil where appropriate.

Where lesson time is lost because the pupil arrives late, that lost time will normally not be added to the end of the lesson.

5. Pupil Responsibilities

Pupils are responsible for:

  • Arriving on time and being ready to drive.

  • Providing a suitable and safe collection point.

  • Holding a valid provisional driving licence or other legal entitlement to drive.

  • Meeting the legal eyesight requirements.

  • Informing their instructor of any relevant medical condition or restriction that may affect their ability to drive safely.

  • Following reasonable instructions given by their instructor.

  • Treating their instructor and other road users with respect.

  • Not attending a lesson under the influence of alcohol or drugs.

  • Not behaving in a way that puts the instructor, themselves or other road users at unnecessary risk.

Prime Auto reserves the right to end a lesson where a pupil's behaviour or condition creates a significant safety concern.

6. Licence and Legal Requirements

Before driving on a public road, pupils must have the appropriate legal entitlement to drive.

The instructor may check the pupil's driving licence and eyesight in accordance with applicable requirements.

Pupils must immediately inform Prime Auto or their instructor if their entitlement to drive changes or is suspended, revoked or restricted.

7. Cancellation and Rearranging Lessons

We require at least 48 hours' notice to cancel or rearrange a lesson without charge.

Where 48 hours or more notice is provided:

  • The lesson may be rearranged.

  • A prepaid lesson may be refunded where appropriate.

  • No cancellation charge will normally apply.

Where less than 48 hours' notice is provided, the full lesson fee may be charged.

This is because the instructor has reserved that time specifically for the pupil and may be unable to offer the appointment to another customer.

8. Late Cancellation and No-Shows

A lesson may be treated as a late cancellation where:

  • The pupil cancels with less than 48 hours' notice.

  • The pupil does not attend.

  • The pupil is unavailable at the agreed collection point.

  • The pupil is unable to drive for a reason that was not communicated to the instructor.

  • The pupil arrives so late that the lesson cannot reasonably be completed.

In these circumstances, the full lesson fee may be payable.

Where appropriate, Prime Auto or the instructor may use reasonable discretion in genuine exceptional circumstances.

9. Pupil Lateness

Pupils should be ready at the agreed collection point at the scheduled lesson time.

If a pupil is late, the instructor will normally wait for a reasonable period where possible.

The lesson will generally still finish at the originally agreed time.

Prime Auto does not normally provide additional lesson time or refunds for time lost because of pupil lateness.

If a pupil is more than 15 minutes late without contacting the instructor, the lesson may be treated as a no-show.

10. Instructor Cancellations

There may be occasions when an instructor needs to cancel or rearrange a lesson.

This may occur because of:

  • Illness.

  • Vehicle problems.

  • Breakdown or accident.

  • Dangerous weather or road conditions.

  • An emergency.

  • A driving test or other unavoidable professional circumstance.

  • Other circumstances outside the instructor's reasonable control.

Where an instructor cancels a lesson, the pupil will not be charged for the cancelled lesson.

The lesson will normally be rearranged for another suitable time.

If the pupil does not wish to rearrange, any refund due will be dealt with in accordance with our Refund & Cancellation Policy.

11. Vehicle Safety

Prime Auto Driving School takes vehicle safety seriously.

An instructor may refuse to commence or continue a lesson if they reasonably believe that the vehicle, road conditions, weather or circumstances make continuing unsafe.

The instructor's decision regarding immediate driving safety will be final.

Where a lesson cannot reasonably proceed because of circumstances outside the pupil's control, the lesson will normally be rearranged.

12. Driving Tests

Pupils are responsible for booking their practical driving test unless an alternative arrangement has been agreed.

The instructor will provide reasonable guidance regarding test readiness.

Passing a driving test cannot be guaranteed.

An instructor may advise a pupil not to take a test if, in their professional judgement, the pupil is not yet consistently demonstrating the required standard.

The final decision to take a test remains with the pupil, subject to the applicable DVSA requirements.

13. Use of the Driving School Vehicle for a Practical Test

Where Prime Auto agrees to provide a vehicle for a pupil's practical driving test, the pupil must comply with any conditions communicated by the instructor.

These may include:

  • Completing sufficient preparation before the test.

  • Meeting the instructor at the agreed time.

  • Paying any applicable vehicle/test-day fee in advance.

  • Complying with the instructor's reasonable requirements regarding the condition and use of the vehicle.

The instructor may refuse use of the vehicle where the pupil's driving ability, conduct or circumstances create a reasonable safety concern.

Where an instructor decides that a vehicle cannot safely be provided for a test, the pupil will be informed as soon as reasonably possible.

14. Payment

Payment must be made using the payment method agreed at the time of booking.

Where lessons are paid for in advance, the pupil should retain their payment confirmation or receipt.

Prime Auto will maintain appropriate records of payments received and lessons provided.

Any outstanding lesson fees must be paid before or at the time agreed for the lesson.

15. Block Bookings and Lesson Packages

Where Prime Auto offers discounted block bookings or packages, the specific price and number of lessons included will be confirmed at the time of purchase.

Block-booking discounts are offered on the basis that multiple lessons are purchased together.

If a pupil requests a refund after completing part of a discounted package, Prime Auto may recalculate the value of lessons already taken using the applicable standard lesson price.

Any remaining eligible balance will then be considered for refund.

This does not affect any statutory consumer rights.

16. Refunds

Refunds are dealt with under our separate Refund & Cancellation Policy.

Unused prepaid lessons may be refundable depending on the circumstances.

Completed lessons are not refundable merely because a pupil subsequently decides not to continue learning.

Where a refund is legally due, Prime Auto will process the refund in accordance with applicable law.

Nothing in these terms is intended to remove a consumer's statutory rights.

17. Complaints

We want pupils to have a positive experience and encourage them to raise concerns as soon as possible.

If you have a complaint, please first contact:

Prime Auto Driving School

We will review the complaint and aim to resolve it fairly and promptly.

Where a complaint concerns an individual instructor, we may need to discuss the matter with that instructor as part of our investigation.

If a complaint cannot be resolved, pupils may seek further guidance from the DVSA, Citizens Advice or another appropriate consumer advice service.

The DVSA's current guidance states that complaints about an instructor's professional service can be raised with the DVSA after the school's/instructor's own complaints procedure has been followed.

18. Instructor Standards

Prime Auto expects instructors operating with the school to behave professionally and respectfully.

Instructors are expected to:

  • Provide tuition to an appropriate professional standard.

  • Treat pupils fairly and respectfully.

  • Prioritise road safety.

  • Keep appropriate records of pupil progress.

  • Provide reasonable guidance regarding test preparation.

  • Follow applicable legal and professional requirements.

Prime Auto does not tolerate abusive, threatening, discriminatory or inappropriate behaviour towards pupils, instructors or other road users.

19. Equality and Respect

Prime Auto Driving School aims to provide an inclusive and respectful learning environment.

We do not tolerate discrimination, harassment, bullying or inappropriate behaviour.

Pupils will be treated fairly regardless of age, disability, sex, race, religion or belief, sexual orientation or other protected characteristic.

Our instructors are also entitled to be treated with respect.

20. Privacy and Personal Information

Prime Auto may collect and process personal information necessary to provide driving lessons and manage bookings.

This may include:

  • Name and contact details.

  • Booking information.

  • Lesson and payment records.

  • Driving licence information where necessary.

  • Information required to provide safe and appropriate tuition.

Personal information will be handled in accordance with our Privacy Policy.

21. Photography, Video and Dash Cameras

Where video or audio recording equipment is used during tuition, it will be used in accordance with applicable legal and data-protection requirements.

Recordings will not be published or shared publicly without appropriate permission where permission is required.

Pupils should not make recordings during lessons where doing so could distract the driver or compromise safety.

22. Lesson Progress

Learning to drive is an individual process and the number of lessons required will vary between pupils.

Prime Auto cannot guarantee:

  • A particular number of lessons will be sufficient.

  • A pupil will pass their driving test by a particular date.

  • A particular test date will be available.

  • A pupil will pass their first driving test.

Instructors will provide honest professional guidance based on the pupil's progress.

23. Exceptional Circumstances

Prime Auto understands that genuine emergencies and unexpected circumstances can occur.

Where appropriate, we may exercise reasonable discretion regarding cancellation charges or rearrangements.

Examples may include serious illness, bereavement or another significant unforeseen event.

Evidence may be requested where appropriate.

This discretion does not remove or reduce any statutory consumer rights.

24. Changes to Prices or Services

Prime Auto may change its prices, services or availability from time to time.

Any changes will apply to future bookings and will not retrospectively alter the price of lessons that have already been paid for and confirmed.

Any important changes to these Terms & Conditions will be published on our website.

25. Limitation of Liability

Prime Auto will provide its services with reasonable care and skill.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded or limited.

26. Consumer Rights

These Terms & Conditions are subject to applicable UK consumer protection legislation.

Nothing in these terms affects your statutory rights.

Where a provision of these Terms & Conditions conflicts with a mandatory legal requirement, the legal requirement will take precedence.

Consumer contracts must be fair and transparent, and terms that impose disproportionate cancellation charges or automatically retain all upfront payments may be considered unfair.

27. Governing Law

These Terms & Conditions are governed by the law applicable in England and Wales.

Any dispute will be dealt with in accordance with applicable UK law and the appropriate courts.

EARN WHILST YOU TRAIN

Let's be honest. It is difficult to train and not earn whilst doing so.

After you have completed your Part 2 test, you have the opportunity to earn whilst you train for Part 3.

This is known as a trainee (pink) badge. Allowing you to gain experience and get paid for it, a trainee license is valid for 6 months before you can reapply for another trainee badge. There is a maximum of 2 trainee badges, which you will then be required to complete your Part 3 test.
